1.1 Welcome to Sustainable Squad. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Services"). The Services are operated and owned by Sustainable Squad Pte. 1.4 Depending on your country of residence, transactions may be processed either by Sustainable Squad Pte. Ltd. or Sustainable Squad s.r.o.

2. Our Services

2.1 Overview: At Sustainable Squad, we strive to contribute to a healthier planet through our core offering - the service of planting trees. This service is provided in the form of digital certificates, with each certificate representing a commitment to plant a specific number of trees.

2.2 Service Fulfilment: Our services are fulfilled through partnerships with various third-party organizations that have the expertise and infrastructure necessary to plant trees in an ecologically responsible manner. These organizations are thoroughly vetted by us to ensure they meet our environmental and ethical standards.

2.3 Digital Certificates: When you purchase our services, you are issued a digital certificate as proof of your contribution to global reforestation efforts. This certificate does not grant you any rights or ownership over the trees planted or the land they are planted on. The sole purpose of the certificate is to acknowledge your contribution.

2.4 Persistent Hero Membership: In addition to single tree planting services, we offer a 'Persistent Hero' membership plan. Under this plan, you can subscribe to a certain number of trees and commit to a specific price you wish to contribute each month. Upon your confirmation, we will immediately deduct this amount from your credit card. Subsequent deductions will take place every 1 month thereafter. You can cancel this subscription at any time through a link provided in the confirmation email.

2.5 Order Fulfilment: Once you place an order on our platform, we commit to passing it to our partner organization within 30 days. The actual tree planting is scheduled in the months following the placement of your order. The timing is subject to various factors, including but not limited to weather conditions, seasons, and the availability of suitable land for planting.

2.6 No Physical Delivery: As our services are provided digitally, no physical delivery is involved in the process. All communications and proofs of purchase are delivered to you via email or other digital means as per the information provided by you at the time of purchase.

2.7 Service Variations: The specific details of tree planting - such as the species of tree planted, the location of the planting, and the date of planting - may vary based on several factors. These factors include the partner organization's strategic planting plan, the local ecosystem's needs, and the best environmental practices at the time of planting.

3. Order Cancellation, Refund, and Recurring Payments

3.1 Single Order Cancellation and Refund: We understand that circumstances may change, and you may need to cancel your order. If you've made a single purchase, you have the right to cancel this order for any reason within 14 days of purchase. To exercise the right of cancellation, you must inform us of your decision by means of a clear statement (e.g., a letter sent by email). If you cancel your order within the stipulated 14 days, you are eligible for a full refund. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. We will process the refund without undue delay, and not later than 14 days from the day on which we are informed about your decision to cancel your order.

3.2 Persistent Hero Membership Cancellation and Refund: If you have subscribed to our 'Persistent Hero' plan, you may cancel your subscription at any time using the cancellation link provided in the confirmation email. Upon receipt of your cancellation request, we will cease all future charges and the service will be discontinued from the following month. Please note that we will not refund any payments made before the cancellation request and that were processed more than 14 days in the past.

3.3 Immediate Charges for Persistent Hero Membership: Please be aware that as soon as you confirm your 'Persistent Hero' membership, we will deduct the agreed-upon amount from your credit card. This transaction is considered final and is not refundable unless it is your first payment and you request a cancellation within the initial 14-day period.

3.4 Cancellation Process: To cancel your order or subscription, please send an email to our customer service at [email protected], clearly stating your decision to cancel. We will acknowledge receipt of your cancellation and process it promptly.

4. Privacy and Data Protection

4.1 Personal Data Collection and Use: When you use our services, we may collect personal data such as your name, contact information, payment details, and other necessary information. We use this data to process your orders, communicate with you about your orders, and manage our services.

4.2 Data Retention: We retain your personal data for a period of ten years or as long as necessary for bookkeeping or other legal purposes. After this period, your personal data will be deleted from our systems, unless we have a legitimate and lawful reason to continue storing it.

5.1 Order Processing: Once an order is placed through our platform, we make a commitment to pass it to one of our partner organizations within 15 to 45 days. Upon successfully transferring your order, we will send you an email notification to confirm this.

5.2 Tree Planting Schedule: The actual tree planting will occur in the months following the placement of your order. The timing of the tree planting is influenced by various factors such as the season, weather conditions, and the partner organization's schedule and capacity.

5.3 Potential Delays: While we strive to ensure that all trees are planted within the expected timeframe, there may be instances where this process is delayed. Delays can be caused by factors such as extreme weather conditions or unforeseen circumstances affecting our partner organizations. We appreciate your understanding and patience in these situations.

5.4 Unfulfillable Orders: In the unlikely event that an order cannot be fulfilled for any reason, we will notify you as soon as possible. Our policy in such cases is to provide a full refund of the payment made for the unfulfilled order. The refund will be processed using the same method of payment you used for the initial transaction, unless you have expressly agreed otherwise.

6. Disclaimer of Warranties and Limitation of Liability

6.1 General Disclaimer: SUSTAINABLE SQUAD PTE. LTD. and SUSTAINABLE SQUAD s.r.o. (collectively, "Sustainable Squad", "we", "us", "our") provides its services on an "as is" and "as available" basis. We expressly disclaim, to the fullest extent permitted by law, all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.2 Commitment to Service: We are deeply committed to delivering our tree-planting services and we work diligently with our partner organizations to meet our shared goals. While we strive to adhere to our tree planting schedules, please understand that the precise timing of tree planting activities can vary. This is due to a range of environmental and operational factors such as weather conditions, the partner organization's capacity, and other unexpected circumstances. Please rest assured, however, that every effort is made to facilitate the tree planting process in a timely and effective manner, and that your contribution is making a significant difference to our environment.

6.3 Limitation of Liability: In no event will Sustainable Squad, its affiliates, or their respective directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with our services, any damages resulting from the use or the inability to use our services, unauthorized access to or alteration of your transmissions or data, statements or conduct of any third party on our services, any actions we take or fail to take as a result of communications you send to us, any termination of your use of our services, any delay or failure in performance resulting from causes beyond our reasonable control, or in any way connected with your use of our services, regardless of negligence, whether or not we are advised of the possibility of such damages, and notwithstanding any failure of essential purpose of any limited remedy.

6.4 Your Responsibility: It is your responsibility to understand the nature of our services and the inherent uncertainties and risks involved in the process of tree planting. By placing an order, you accept these risks and agree not to hold us liable for any issues relating to the timeframe and completion of tree planting.

The submission of personal information on our platform is governed by our Privacy Policy.
